In a Federal suit to get mortgagors clear title to their home, the
bank failed to respond to our Complaint. The Court found and
ruled that the
facts and allegations of our Complaint are deemed
admitted by Defendant. As such, we are defaulting them, and Mr. and Mrs. G will most likely own their home free and clear.
UPDATE...The court ordered a default judgment against the bank. They have no party to the property, and the G. family now owns their home free of encumbrances. They may stay or sell, as they wish.
In the case of Mr. and Mrs. M, in a suit seeking quiet title and damages, the United States
District Court denied the Defendant bank's Motion to Dismiss without a hearing, and
allowed the case to proceed to discovery once the sworn affidavit was read. The Court's opinion noted
it is plausible the Defendant bank does not own any right to our
client's Mortgage or Note.
In the case of Mr. R. and Mrs. P. and their children, the original mortgagee bank securitized the homeowners’ mortgage and sold it to a trust. The servicing agent then wrongfully foreclosed in its own name without buying the mortgage and without notifying the trust, trying to steal the home from both the trust and the homeowners. To hide what it was doing, the servicing agent caused its foreclosure-mill attorneys to forge an affidavit. The Circuit Court of Cook County caught the forgery and disciplined the attorneys who had forged it. This so prejudiced the court against the servicing agent that the servicing agent has done nothing in the case for a full year and seems to have abandoned the case. The homeowners have paid nothing to the servicing agent for a year, and they and their children will remain in their home as long as they wish. Meanwhile, we are preparing an action for quiet title to file in United States District Court in case the servicing agent ever returns.
